
MONROVIA, Liberia – January 11, 2026 – The Commercial Court of Liberia has ruled that M-Tosh Prints Media failed to prove its claim that the National Elections Commission of Liberia (NEC) owed it US$877,000 in an action of debt case.
In its decision, the Court held that M-Tosh did not meet the required burden of proof to establish that it imported and delivered excess election materials allegedly used by the NEC. The company had claimed it brought in 1,898 additional election materials valued at US$877,000 beyond those stipulated in its contract with the NEC.
The NEC denied the claim, arguing that no contractual provision authorized the importation or storage of excess materials without prior approval from its Board of Commissioners.
After reviewing flight cargo manifests and other documentary evidence, the Court found that the NEC paid for the chartered flight used to transport the materials and concluded that M-Tosh failed to satisfy legal standards governing proof and best evidence.
In her December 31, 2025 ruling, Judge Eva Mappy Morgan also noted that the NEC had already paid M-Tosh for materials it officially used, including US$94,000 for 200 election kits and US$589,060 for pre-packed materials supplied for the Montserrado County District #15 by-election.
As a result, the Court dismissed M-Tosh’s US$877,000 claim, effectively clearing the NEC of liability. M-Tosh Prints Media has since announced plans to appeal to the Supreme Court, while the NEC has also filed a cross-appeal.
